Minor Variance Application – Zoning By-law 22-90

An application for a minor variance to the Town’s Zoning By-law 22-90 has been submitted for the property at 448 Jay Crescent to allow for an increase to the rear yard encroachment for stairs. The variance is required to bring the existing constructed stairs into conformity with Zoning By-law 22-90.
Purpose of the Application:
The property at 448 Jay Crescent is currently zoned for Residential Sixth Density (R6), S.P. 24.84 and S.P. 24.125 which identifies the maximum rear yard encroachment for steps at a total of 0.6 metres. The application seeks provisions under Section 45 of the Planning Act, R.S.O. 1990, c.P13 as amended. The minor variance would increase the step encroachment for the rear yard on the property to 2.7 metres, bringing the stairs into compliance.

Appeals Process:
The applicant, the Minister or any specified person or public body that has an interest in the matter may within 20 days of the making of the decision appeal to the Tribunal against the decision of the committee by filing with the Secretary-Treasurer of the committee a notice of appeal setting out the objection to the decision and the reasons in support of the objection accompanied by payment to the Secretary-Treasurer of the fee charged by the Tribunal as payable on an appeal from a committee of adjustment to the Tribunal.
